I have had an On Line Quote for Right to Buy in Leicester. Is that a fixed fee or can it vary?
Campions Solicitors Fees will not vary on a Right to Buy. They are totally fixed no matter what work is needed. That is true of Right to Buy in Derby and Nottingham- Campions Solicitors operate fixed fees. That is true of anywhere in the country that Campions act.
I am buying a Right to Buy Flat in London. I believe the Title is Leasehold. Campions Property Solicitors charge an additional Leasehold Fee. Why is that?
More work is required for a Leasehold Purchase. The Lease is a lengthy document that has to be examined. This is true of course anywhere that Campions act in the Purchase of flats including Derby, Leicester and Nottingham.
I understand that if a Right to Buy house has Solar Panels on the roof then the Solar Panels will be Leased back to the Local Authority. In this case it is Nottingham City Council since I am buying in the City of Nottingham. Do Campions Solicitors charge extra for the work involved?
Campions Solicitors make an additional charge if the RTB property has Solar Panels.
I am buying a Right to Buy House in Derby from Derby City Council or I am buying the property from Leicester City Council. I wish to start but may not complete. How do I avoid Solicitors Fees?
You can opt for No Completion No Fee. If you pay that amount due at the outset then you will not need to pay any of Campions Solicitors Fees if you withdraw.
Can you explain the fees on the quote for the Bank Transfer Fee?
Yes. On the day of completion of the Right to Buy Purchase Campions make a same day transfer of all money due to the Council or Housing Association concerned. The fee given is Campions charges for making this payment.
Disbursements on Right to Buy Purchases
Can you tell us more please about the three main searches listed which are the Local Search, Mining and Drainage?
Yes. If the property that you are buying through the Right to Buy Scheme is in a former coal mining area you are required to have a Mining Search. The position is the same as on any Purchase. Examples of former mining areas are Ashfield, Mansfield, Gedling and Nottingham in Nottinghamshire. Ashby and Coalville in Leicestershire. Swadlincote and Chesterfield in Derbyshire. There are other areas.
What about the Local and Drainage Search?
In whatever district you are buying under RTB you are required to have the Local Search and the Drainage Search if you are having a Mortgage.
I am buying a house under the Right to Buy Scheme in Sutton in Ashfield and I am paying cash. Do I need to have the Local, Mining and Drainage Searches?
With all cash Right to Buy Purchases this is a decision for you. We do though strongly recommend you have these searches even though you are paying cash.
Can you explain the Registration Fees listed on the quote?
As with any Purchase a Right to Buy must be registered at the Land Registry. The fees for Registration are set out under Scale 1 Land Registry fees. However almost alway if you are buying a house through Right to Buy that is part of a larger Title of land which will be owned by the Local Council from which you are buying. So if you are buying a house a new Title must be created. This means that the fees Campions have to pay to Register are double the standard Scale 1 Fee.
I am buying a flat from Mansfield District Council through Right to Buy. Can you tell me what the Registration fees are?
This is a Leasehold Title. Therefore it is a new Title created by the Local Authority-in this case Mansfield District Council. The fees for Registration are Scale 1 but double just as with a Right to Buy house.
Can I ask you to clarify the payment for three searches, the Identification Search, and if they apply the Source of Funds and Source of Wealth payment?
A Right to Buy Purchase has to be treated in the same way as any other purchase. We have to check the Identity of all buyers under the Money Laundering Regulations 2017. This is partly done electronically through eCOS. A payment has to be made for the electronic Identification Search.
What about Source of Funds and Source of Wealth checks if they apply?
Again a Right to Buy Purchase has to be dealt with in the same way as any other purchase. Campions Right to Buy Solicitors must check Source of Funds and Source of Wealth if relevant. All money used for the purchase of property must comply with Money Laundering Regulations 2017. Part of the checks are done electronically.
Can you explain please the Lender Monitor Fee if it applies?
Campions Conveyancers have to check that the Lenders instructions have not altered from initial instruction. The Lenders Monitors Fee will show this.
What is the purpose of the Bankruptcy Search?
In the case of Right to Buy the Local Authority or Housing Association ask that Campions Solicitors obtain a Bankruptcy Search. The Lenders if you have one will ask for one as well.
