Commission adopts Implementing Regulations under SFTR amending EMIR

On 13 December 2018, the European Commission adopted the following Implementing Regulations under the Regulation on reporting and transparency of securities financing transactions (SFTR) which also amend the European Markets Infrastructure Regulation (EMIR):

  • Commission Implementing Regulation laying down implementing technical standards with regard to the format and frequency of reports on the details of securities financing transactions to trade repositories in accordance with the SFTR and amending Implementing Regulation (EU) No 1247/2012 with regard to the use of reporting codes in the reporting of derivative contracts (together with an annexes); and
  • Commission Implementing Regulation laying down implementing technical standards with regard to the procedures and forms for exchange of information on sanctions, measures and investigations in accordance with the SFTR (together with an annexes)

Both Implementing Regulations will enter into force twenty days after publication in the Official Journal of the EU.
