Your AI image model can generate content that no human ever created. That does not necessarily mean the content is legal. Many AI companies assume there is no criminal exposure if an image does not depict a real person. Federal law does not always make that distinction. 

One federal statute specifically addresses certain computer-generated images, including AI-generated images, even when no actual minor exists. If your platform can generate this type of content, your compliance analysis should begin with the model’s capabilities, not with the assumption that “no real child” ends the inquiry.

Why “No Real Child” Is Not Always a Defense 

One of the most common misconceptions among AI developers is that an image cannot violate federal law unless it depicts a real child. That is not always correct. 

Federal law includes a statute that expressly covers certain computer-generated images, drawings, cartoons, paintings, sculptures, and other visual depictions, even when no actual minor exists. The law is 18 U.S.C. § 1466A, which governs obscene visual representations involving the sexual abuse of children. Unlike many other federal statutes in this area, Section 1466A expressly states that the existence of a real minor is not an element of the offense. 

What Federal Law Says 

Section 1466A makes it a federal crime to knowingly produce, distribute, receive, or possess with intent to distribute certain obscene visual depictions of minors engaged in sexually explicit conduct. The statute expressly applies to computer-generated images as well as traditional artwork and other visual media. 

Congress drafted the statute to address constitutional concerns raised by the Supreme Court’s decision in Ashcroft v. Free Speech Coalition (2002), which struck down an earlier prohibition on virtual child pornography that did not involve real children. Section 1466A survives that decision because it reaches only material that also satisfies the legal standard for obscenity. That additional requirement limits the statute’s scope, but it does not create a safe harbor for AI-generated images simply because no real child exists. 

Has Anyone Been Prosecuted Under This Law for AI-Generated Images? 

In United States v. Anderegg (W.D. Wis. 2025), federal prosecutors charged a defendant under Section 1466A for using Stable Diffusion to generate obscene AI-generated images depicting fictional minors. The court allowed the production and distribution charges to proceed, even though no real child was alleged to exist. It dismissed only the private-possession charge based on a separate constitutional rule that protects certain private possession inside the home. 

For AI companies, the distinction matters. Commercial AI platforms generate images in response to user prompts and deliver those images to users. That conduct aligns much more closely with production and distribution than with private possession. The case reinforces the point that “no real child was involved” does not eliminate potential criminal exposure for an AI platform whose image model can generate this type of content. 

What Makes an AI Image Model High Risk? 

Your Model’s Capabilities Matter More Than Your Intent 

Many AI companies see themselves as neutral infrastructure. Section 1466A focuses on something different: what your product can generate. 

If your AI model can produce sexual images of apparent minors, your platform may create criminal exposure under federal law, even if no real child exists and even if the content was generated entirely by AI. The legal analysis begins with the model’s capabilities, not with the platform’s intentions or how users describe the images. 

Image generation, therefore, deserves a different level of compliance review than text generation. Before deploying an image model, operators should understand what the model can produce, what safeguards already exist, and where those safeguards fail. 

User Policies Cannot Remove Product Risk 

Many platforms prohibit illegal content in their Terms of Service. Those rules help establish user expectations, but they do not eliminate the risks created by an uncensored image model. 

If users can repeatedly generate prohibited images despite your published policies, the issue is no longer one of user conduct. It becomes a product design issue. From a compliance perspective, technical safeguards carry far more weight than contractual restrictions that users can simply ignore. 

Why Image Models Require a Different Analysis Than Text Models 

Section 1466A regulates visual depictions. As a result, an image-capable AI platform generally faces a different compliance analysis than a text-only service. 

That distinction does not mean text models present no legal risks. Other federal statutes may apply to text-based exploitation or reporting obligations. Under Section 1466A, however, the primary concern is whether the platform can generate or distribute prohibited images. 

What Should AI Companies Do Now? 

Evaluate Your Model Before Users Do 

The first step is understanding exactly what your image model can generate. Test prompts, evaluate outputs, and identify whether users can produce prohibited content through prompt engineering, image editing, or other techniques. Compliance begins with a realistic assessment of your model’s capabilities rather than its intended use. 

Build Technical Controls Into the Product 

The strongest safeguard is preventing prohibited content from being generated in the first place. Prompt filtering, output classifiers, safety tuning, human review where appropriate, and ongoing testing all reduce the likelihood that prohibited images reach users. These controls should evolve alongside the model rather than remain fixed after deployment. 

Treat Compliance as an Engineering Function 

Section 1466A sends an important message to AI companies. Product safety cannot depend entirely on Terms of Service or after-the-fact moderation. Compliance should influence how the model is designed, tested, deployed, and monitored throughout its lifecycle. 

For image-capable AI platforms, legal compliance is not simply a trust and safety function. It is an engineering and product governance function.

Many AI companies assume that if no real child appears in an AI-generated image, federal criminal law does not apply. Section 1466A reaches further than many founders, product teams, and model operators realize.
