Partner Susan Kayser and Associate Keehle Amicon secured a significant early victory for client American Humane Association (AHS) in the U.S. District Court for the District of Columbia when the Court denied in part Humane World for Animals, Inc.’s (HWFA) motion to dismiss and allowed AHS’s key counterclaims to proceed. The ruling confirms that HWFA cannot avoid scrutiny of its asserted rights by arguing that the phrase “humane society” is not truly at issue in the case, and that AHS adequately pleaded its federal and common law unfair competition claims. In doing so, the Court ensured that the dispute over attempts to monopolize common industry terms remains squarely before it.
