Express Solicitors is helping patients of Mr Mian Munawar Shah claim compensation for medical negligence. With this high-profile case making news headlines, head of medical negligence, Carlos Lopez provides the latest and walks through the options available to those affected by the care received by Mr Mian Munawar Shah.

Express Solicitor’s client, Angela Glover is just one of hundreds of patients that face recall over shoulder surgery carried out by Mr Mian Munawar Shah, an orthopaedic surgeon who practised at Walsall Manor Hospital and prior to 2020, at the private hospital, Spire Little Aston.

What is the latest on Mr Mian Munawar Shah?

BBC Midland’s health correspondent, Michele Paduano confirmed in an article that Mr Shah has now been sacked by Walsall Healthcare NHS Trust. This was later confirmed in a statement by the Trust.

Following Mr Shah’s dismissal, Walsall Healthcare Trust has also now established that around 400 patients will now be contacted as part of a recall recommended by the Royal College of Surgeons. External consultants will carry out a review and all patients who underwent procedures of potential concern will be identified and contacted.

We are currently supporting Angela Glover in her quest for compensation against Mr Mian Munawar Shah for negligent shoulder surgery he performed at Walsall Manor Hospital. Angela’s story was covered in the BBC report.

Having successfully secured an admission of liability from Walsall Healthcare Trust for Angela’s poor treatment, misdiagnosis and severe postoperative pain, which has had a devastating effect on Ms Glover’s life. We believe there will be more similar cases in the future.

Handling compensation cases of Mr Mian Munawar Shah’s patients

I’m minded to believe that despite recent press reports of NHS failings, it remains fair to say that in the majority of cases patients have a positive experience of their NHS treatment.

In the case of our client, Angela Glover this was unfortunately not the case and she pursued a successful claim against Mr Shah with our support.

An admission of liability was obtained from the Hospital Trust for the poor treatment she received, including initial assessment, original and revision Latarjet procedure and the delays in identifying the cause of her severe pain. Evidence obtained showed both procedures were technically poorly performed, with significant misplacement and poor position of the graft, the cause of the severe postoperative pain, which left her with life-altering consequences and suffering daily pain.

Options available to others affected by the care received by Mian Munawar Shah

Given the high number of recalls – around 400 being quoted from the Walsall Hospital Trust – there will be others in similar situations to Angela Glover.

Patients should be made aware that the dismissal of Mr Shah’s from Walsall Manor Hospital doesn’t bring an end to the complaints procedure. There are still a number of options open to a patient. The first of which is to bring a complaint to the Trust and indicate the date of procedure and the type of procedure undertaken by Mr Shah. A patient can write either to the Trust Chief Executive, at the relevant hospital or through the Patient Advice and Liaison Service ( PALS).

Those affected should also ask for an investigation to be undertaken into their case, by the hospital and for a copy of any Serious Incident report subsequently generated. Patients should ask the trust to clarify whether the procedure undertaken was correct and within the skill and expertise of this surgeon and whether they now need to see a further consultant or be required to undergo any further surgery in the future.

While there are exceptions to the rule, in most circumstances patients have a three year limit to make the claim, from when they became aware of any negligence or substandard treatment.

Instructing lawyers to seek compensation for care received by Mian Munawar Shah

Speaking with Angela Glover recently, on the situation she finds herself in as a direct result of the failing in the standards of care received from Mian Munawar Shah. She said:

“I’ve got lots of unanswered questions and I’m really focused on finding out the answers to these. Mr Shah’s substandard care, misdiagnosis and botched surgery has fundamentally changed my life and I need to seek justice.

“To be told that the initial diagnosis and surgery and subsequent multiple operations to correct the damage was not only wrongly carried out, but poorly executed and has resulted in my life literally being turned upside down is devastating to hear.

“I’m now facing my fifth surgery next year. I’ve also had to alter the hospital department I work in as I can no longer manually lift patients. He’s taken so much away from me, I just hope I can improve procedures and patient safety so there’s never a repeat of this type of negligence again.”

Angela’s case for compensation is even more complicated as she is currently employed by Walsall Manor Hospital.

Angela Glover’s quest for compensation from Mr Mian Munawar Shah

“I actually got a scan the next day at work, which picked up a tear in my shoulder.”

Angela, now 49 was working at Walsall Manor Hospital in the scanning room, when a patient slid to the floor and wouldn’t let her and her colleague use the correct lifting equipment to get her up off the floor. As the patient was pushing herself up, she pulled up on Angela’s shoulder.

“I actually got a scan the next day at work, which picked up a tear in my shoulder. I was then sent for physio and injections, but nothing really changed.

“I ended up seeing Mr Shah, and he suggested persevering with a few more injections and physio. However, before I knew it, he’d booked and performed a camera scope and diagnosed a shoulder dislocation. He then recommended a latarjet procedure, and placed pins in me to stabilise my right shoulder.

“Straight away after surgery the pain was terrible.”

“Straight away after surgery the pain was terrible. It was just getting worse and worse over the coming days and I actually ended up in A&E with the pain. I went in and out of A&E for 2-3 months but was always just sent away with pain relief.

“In the end I went to Birmingham Hospital and got a second opinion. They couldn’t find any evidence of dislocation and there never was any. A Royal College of Surgeon report says there was no evidence of dislocation either. He simply misdiagnosed me and also performed treatment on my shoulder that I didn’t even need. If Mr Shah hadn’t done what he’d done, then I would have made a full recovery.

“If Mr Shah hadn’t done what he’d done, then I would have made a full recovery.”

“The suffering caused my nervous breakdown. I was so tired of everyone telling me there was nothing wrong, that I went to the canal and tried to take my own life. I just wanted to be with my Dad. The pain wouldn’t go away and no one was listening to me.

“Luckily, I found some inner strength and went to speak to someone at work again about it. After securing a CT scan, which confirmed that Mr Mian Munawar Shah had bolted my shoulder joint down. Basically, the pins he’d placed were all in the wrong place.

“I’m now facing my fifth operation to see if they can release the shoulder as it’s too tight.”

Angela faces a daily battle

“Due to my restrictions with my right shoulder, I’m now working in the antenatal department as I can no longer do any manual handling. The job entails a bit of computer work but even for that the department has had to make adaptations and supply special equipment to help support my disabilities. As a result, I’m now getting pain in my left shoulder as I’m over compensating.

“I’m now facing my fifth operation to see if they can release the shoulder as it’s too tight.”

Prompted compensation

“I’m doing my best to try and get back to work. My next surgery keeps getting delayed so I’ve been signed off sick for the past six months. I’ve had a real tough journey and fingers crossed this next operation provides some relief from the excruciating pain I’m experiencing.”

Future outcome following claim again Mr Mian Munawar Shah

“In terms of the future, I’ve been told I may need several shoulder replacements and with the degeneration and nerve damage caused will more than likely have to live with chronic pain and arthritis.

“I just feel really let down and I hope with the help of Express Solicitors and support of my colleagues, I will prevent anything like this from occurring again.”
