China Issues Measures for Supervision of Online Transactions

On 15 Mar. 2021, the State Administration for Market Regulation (SAMR) issued the Measures. The Measures shall come into force as of 1 May 2021. The Administrative Measures for Online Transaction (网络交易管理办法) promulgated in the Order No.60 by the former State Administration for Industry and Commerce on 26 Jan. 2014 shall be abolished at the same time.

The Measures shall apply to business activities within the territory of the People’s Republic of China, including selling goods or providing services through the Internet and other information networks (hereinafter collectively referred to as the “network”). Market supervision and administration departments shall supervise and regulate the above business activities, and other business activities such as selling goods or providing services via online social networking, live broadcast and other information networking activities.

The Measures consists of 56 articles in five chapters, which respectively stipulates the obligations of online transaction operators and online transaction platform operators, the supervision and administration of market supervision and management departments, and the liabilities for illegal online transactions.
