On 22 Jan., the Standing Committee of the 13th National People’s Congress voted at the 25th session to adopt the Administrative Punishment Law of the People’s Republic of China, which will come into force on 15 July 2021.
The newly revised Administrative Punishment Law supplements the types of administrative punishment, with behavior punishment and qualification punishment introduced. It also explicitly provides that the illegal income shall be confiscated except for those that shall be refunded or compensated according to law. Besides, it is clarified that where an illegal act endangers the life, health or financial security of citizens and causes harmful consequences, the period for pursuing liability shall be extended to five years.
