Defense Verdict in Harrison County Trip and Fall Case

By Philip Thomas on April 21, 2014

A Harrison County Circuit Court jury rendered a defense verdict on April 10, 2014 in Bonn v. Rouses Enterprises, L.L.C.

The plaintiff tripped and fell in a Rouses supermarket in 2011. Plaintiff had a total knee replacement three months after the fall. Plaintiff’s total medical bills were $105,000. She also had a claim for lost wages.

Plaintiff asked for a bit over $441,000 in closing argument.

Jim Wetzel and Garner Wetzel of Gulfport represented the plaintiff. Chris Massenburg and Adam Hays of Swetman Baxter Massenburg in Hattiesburg represented the defendant. Judge John Gargiulo presided in the case.

My Take:

A bit off point, but word on the street in Gulfport back at Mardi Gras identified Judge Garguilo as slated to become the new federal court magistrate in Gulfport. I’m not sure if there has been an official announcement or not.

Judge Gargiulo would join Judge Ozerden as Gulfport natives and 1985 high school graduates stationed in the Gulfport federal courthouse. Something to know for the next time you are playing Mississippi Litigation Trivial Pursuit.
