In Eaton v. Frisby the parties have entered into an agreed scheduling order that sets the trial date as November 4, 2013. Here is the Order.
Although this is a very interesting case, it’s hard to say how interesting the trial will be. The jury will presumably not get to hear about Eaton’s shenanigans with Ed Peters.
This trial will last forever judging by the huge cast of lawyers involved and the money at stake. My guess is that there will be a lot of bench conferences and arguments outside the presence of the jury that will make trying to watch this trial boring.
But it will be a high profile trial that will be great for the lawyers involved.
