Earlier this month, a coalition of 17 state attorneys general (AG) and the National Association of Wholesaler-Distributors filed a federal lawsuit challenging California’s Plastic Pollution Prevention and Packaging Producer Responsibility Act, known as SB 54 or the Plastics Act. The complaint was filed in the U.S. District Court for the Eastern District of California.
The Challenged Law
The Plastics Act requires producers to reduce single-use plastic packaging and plastic food service ware by 25%, ensure covered single-use packaging and plastic food service ware are recyclable or compostable, and achieve specified recycling targets by 2032. The law also requires covered producers to participate in a producer responsibility organization, with the Circular Action Alliance as California’s initial producer responsibility organization.
The Lawsuit
Plaintiffs argue that the Plastics Act violates the Constitution (specifically, the Commerce Clause, due process, and the First Amendment) and unlawfully delegates government regulatory powers to a private party (the Circular Action Alliance). Plaintiffs also argue that implementing regulations impose significant compliance costs that will result in price increases for everyday consumer goods. The lawsuit seeks declaratory and injunctive relief to block implementation and enforcement of the Plastics Act.
Plaintiffs contend that California’s large market effectively allows the state to set policy that affects businesses and consumers in other jurisdictions. Supporters of the law, however, dispute that characterization and counter that the act operates within California’s regulatory authority. Separately and shortly before this lawsuit challenging the act, environmental groups filed a lawsuit in San Francisco state court alleging that the act’s implementing regulations contain loopholes that undermine the law’s recycling and plastic-reduction goals.
Joining Nebraska in the lawsuit are the AGs of Alabama, Florida, Georgia, Idaho, Indiana, Iowa, Louisiana, Missouri, Montana, North Dakota, Oklahoma, South Carolina, South Dakota, Texas, Utah, and West Virginia.
Why It Matters
This lawsuit is part of a broader pattern of state attorneys general bringing litigation to challenge the extraterritorial reach of regulations in other states. Certain plaintiffs have previously challenged California’s electric vehicle and trucking mandates on similar grounds, arguing that California’s market influence can effectively require out-of-state businesses and consumers to conform to regulatory standards in which they had no direct legislative role.
For businesses that sell packaged goods in California, the outcome of this litigation is significant. Companies should monitor developments closely. The lawsuit also reflects multistate AG coalitions as a means to contest the national reach of individual state regulations.
