Plaintiff appealed the entry of judgment in favor of defendant on plaintiff’s claims of unlawful race/sex discrimination and retaliation. Plaintiff argued that the trial court erred in denying her request to allow the jury to take notes during trial. Defendant also cross-appealed the denial of its motion for attorneys’ fees.
Where there was no evidence that plaintiff requested to allow the jury to take notes, she could not establish error, and a motion for attorneys’ fees had to be an independent action, such that the trial court’s order did not constitute a final appealable judgment.
Judgment is affirmed; cross-appeal is dismissed.
