A man left with ongoing pain following a Kansas car wreck reached a pre-suit settlement for the at-fault driver’s policy limits, as well as for his medical bills.

Laurie Del Percio of The Horn Law Firm in Independence said Justin Jones was traveling northbound on Clairborne Road on the morning of Sept. 11, 2023, when he was struck at the intersection with Santa Fe Street.

According to Del Percio, defendant James Robinson admitted he was not paying attention and ran the red light as he was trying to make a lane change.

The collision caused Jones’ airbags to deploy. He was taken to an area hospital by ambulance, where he was diagnosed with muscular pain and shoulder pain. He was discharged with a muscle relaxer.

Jones sought physical therapy and chiropractic adjustment, as he continued to suffer from pain in his neck, back, shoulders and arms. He experienced headaches, dizziness, fogginess, ringing in his ears and difficulty with sleep. Moving his head exacerbated his symptoms. The pain impacted his ability to sit, work on the computer and concentrate. He was given a transcutaneous electrical nerve stimulation unit to aid in his recovery.

“Mr. Jones is now in the position of having to manage his injuries,” Del Percio said. “In regard to his orthopedic injuries, Mr. Jones is avoiding and/or limiting his physical activities in order that he does not further aggravate areas around his cervical, thoracic and lumbar spine. This means that he must live cautiously and no longer has the freedom of movement as he had in the past.”
