Curran v Yaramati [2023] NSWDC 546 (on Caselaw).
In this matter it was alleged that the defendant who was a general practitioner failed in breach of duty to diagnose potential coeliac disease in the plaintiff, to refer the plaintiff for testing and to provide appropriate advice.
Dr Yaramati denied any breach of duty of care, and also asserts that causation and damages have not been established by the plaintiff. In addition, Dr Yaramati has pleaded a defence under section 5O of the Civil Liability Act 2002 (NSW).
The court held that there was no breach of duty.
