Special leave to appeal was granted in this matter, from the Victorian vicarious liability decision Bird v DP (a pseudonym) [2023] VSCA 66 (3 April 2023).
It would appear that the High Court will consider whether the principle of vicarious liability is limited to the relationship of employer‑employee.
If a notice of contention is filed, the Court may also touch on the relationship between those principles and the principles that govern non‑delegable duties.
