Yesterday’s post highlighted how conservative commentator Greg Jarrett bungled the Foreign Corrupt Practices Act when discussing Hunter / Joe Biden.
This post discusses how conservative commentator Bill O’Reilly has done the same thing.
In this video clip, O’Reilly attempts to describe how “the [Biden] family has already violated the Foreign Corrupt Practices Act.”
O’Reilly begins by saying that he “stumbled” upon the FCPA, but rest assured he and his staff have done their research on the law “as we always do.”
During the clip, O’Reilly stated:
“Hunter Biden was involved with a quid pro quo with foreign businesses … so the foreign businesses got something … in return for Hunter Biden being paid millions of millions of dollars … Burisma Oil in Ukraine got protection from Ukrainian investigators. This falls right under the FCPA and Joe Biden as Vice President was right in the middle of that.”
Missing of course from O’Reilly’s amateur FCPA analysis is any discussion of money or other things of value being offered or provided to a “foreign official” to influence the foreign official’s discretion in order to assist in obtaining or retaining business.
“Foreign official” of course is a required legal element for there to be an FCPA anti-bribery violation.
