Conduct: Medical practitioner & patient inheritance.

Health Care Complaints Commission v Alexakis [2023] NSWCATOD 99 (on AUSTLII).

This decision is of interest because of an allegation of unsatisfactory professional conduct. Complaints 3 and 4 alleged boundary and other transgressions in relation to the treatment of Patient B. The Commission alleged by those Complaints that the practitioner’s conduct “ultimately resulted in [the Practitioner] being bequeathed virtually all of Patient B’s estate”. There was also an allegation of inadequate record keeping in relation to the treatment of Patient B. 

Different allegations were made in relation to another patient.

Ultimately the Tribunal made findings of unsatisfactory professional conduct and professional misconduct.

Not taken into account in these proceedings was the outcome of a Supreme Court judgment in proceedings involving the Will of Patient B, in which the practitioner was a party: see Alexakis v Masters (No 2) [2023] NSWSC 509 (on AUSTLII).
