On 5 November 2021 the High Court refused leave in a special leave application arising from Ethicon Sarl v Gill [2021] FCAFC 29 and the primary decision of Katzmann J Gill v Ethicon Sarl (No 5) [2019] FCA 1905.
In the primary decision, damages were assessed for the three lead plaintiffs. The remaining members of the class can now bring individual claims for compensation which will be assessed by the Federal Court.
