In the absence of any ongoing Australian claims data publication (save for run off scheme data), it is interesting to note the similarities between recent UK National Health Service data and the earlier AIHW data.
Nigel Poole QC reports that in a written answer to the House of Lords on 6 February 2020, the Government stated that NHS Resolution resolved almost 11,500 claims in the 2018 – 2019 financial year.
- 7673 claims were settled without legal proceedings being commenced.
- Of those, 4015 were resolved with compensation being paid to the claimant, and 3858 with no compensation paid.
- 3544 claims were resolved after legal proceedings had been commenced.
- Of those, 2872 were resolved before trial and with the payment of compensation;
- 615 were resolved before trial without the payment of compensation; and
- 57 cases went to trial.
- 22 of those were decided in favour of the claimant with the payment of damages by the NHS; and
- 35 were resolved without the payment of compensation.
