ECT: Injunction to suspend therapy

By Bill Madden on August 11, 2019

The plaintiff suffers from chronic treatment resistant schizophrenia. The Mental Health Review Tribunal authorised a course of electroconvulsive therapy, and the plaintiff underwent 3 of the 12 sesssions allowed for.

The plaintiff, by her father, complained that she should not have to undergo the further treatment and obtained a short term ex parte injunction to suspend the therapy but did not appeal against the decision of the Mental Health Review Tribunal.

ZLF v South Western Sydney Local Health District [2019] NSWSC 1016 (read on Caselaw) the court (Equity Division) considered whether the interlocutory injunction should continue.

The father indicated to the court that he did not press for continuance of the injunction,  which was therefore dissolved.
