On February 6, William J. Baer, the Assistant Attorney General for the Antitrust Division, spoke at the Global Competition Review Fourth Annual Antitrust Law Leaders Forum in Miami. Baer observed that he views the Antitrust Division’s mission as law enforcement, rather than regulation: “We do not aspire to be regulators or to pick winners and losers.” Baer touted the division’s embrace of predictive coding, and said that the division needs to focus on providing meaningful front-end guidance to market players.
