Judge Baer Conditionally Certifies FLSA Class of Unpaid Magazine Interns

In an opinion dated Thursday, Judge Baer conditionally certified, under the Fair Labor Standards Act, a class of of unpaid interns at 19 Hearst magazines who claimed their internships consisted of “tasks necessary to [Hearst’s] operations,” such as answering phones and making deliveries.  One intern submitted an affidavit stating: “My primary job responsibility was to pick-up and return sample clothing items that were being considered for inclusion in the magazine. . . . I was required to wear fashionable attire to make these deliveries and was not allowed to wear walking shoes.”
