In a letter endorsement today, Judge McMahon refused to consider a request from the defendants to vacate an order entered by the clerk’s office to send the dispute to bankruptcy court. The letter noted that the defendants were also sending a separate letter requesting that Judge Kaplan accept the case as related to two others before him. Said Judge McMahon: “I do not do motions by letter. If Judge Kaplan takes this case, fine. If not, all issues raised in this letter need to be the subject of a MOTION.”
